PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE PLACING AN ORDER WITH US.

The following are the Terms and Conditions of Always Keepsakes and Castings and sets out the conditions on which we do business with you, the customer.

3.1 Delivery is in person at the collection point agreed with the date and time. All goods must be checked upon receipt for any defects or spelling mistakes. All mistakes and defects will be reproduced at our expense if our mistake was made. If the mistake was on your behalf then payment will need to be made for a replica item.

4. Returns and Refunds

4.1 You have the right to cancel your order but please note that if your fingerprint or inkless wipe kit has already been sent there will be a £10.00 cancellation fee, and you may keep the print kit. If your impressions have been returned to us and your order is in process, regretfully you will be unable to cancel your order. Once we have taken the mouldings and cast your 3D item there is a charge at the single item prices for the age related. If your frame has been made then no refunds can be made.

 4.2 Please note that whilst we are sure that you will be truly delighted with your purchases from Always Keepsakes and Castings, we are unable to accept returns on Bespoke Personalised orders like Jewellery, Slates or Mugs. An exception to this would be if we have not supplied the item you ordered so please make sure you have ordered correctly before contacting us. Always Keepsakes and Castings cannot be held responsible for customers not following instructions correctly when taking impressions, not checking orders or mis-spelling personalised orders.

4.3 In the unlikely event that we have made an error on your item, you must inform us of this and return the item within one week. we will make a new item for you free of charge. The returned item must be in unused condition. If you have decided to wear or use an incorrect item then regretfully we are unable to replace the item for you.

5. Disclaimer

5.1 Whilst we agree to use our reasonable endeavours to ensure that the Website is fully operational and error-free we cannot guarantee this and therefore accept no responsibility for any defects and/or interruption of the Website and shall be released from our obligations under these Terms and Conditions in the event of any cause beyond our reasonable control which renders the provision of the Website impossible or impractical.

5.2 We exclude, to the fullest extent permitted by applicable laws, and save in respect of death or personal injury arising from our negligence, all liability of any claims, losses, demands and damages arising directly or indirectly out of or in any way connected with the goods supplied by Always Keepsakes and Castings or your use or inability to access the Website. This exclusion shall apply in respect of, without limitation, any costs, loss of profits, loss of contracts or business opportunity, loss of data and any other consequential, incidental, special or punitive damages, even if we have been advised of the possibility of such damages, whether arising in contract, tort, under statute or otherwise or due to representations (other than fraudulent or negligent misrepresentations) PROVIDED THAT nothing contained in these Terms and Conditions affects or will affect the statutory rights of the customer or the recipient in relation to the quality, fitness or description of the goods supplied.

6. General

6.1 We reserve the right to supplement and amend the Terms and Conditions on which you are permitted access to the Website from time to time. Any changes will be posted on the Website and it is your responsibility as a customer to review any changes on accessing the Website. Changes will be effective one (1) hour after the posting of any such change.

6.2 Additionally, we reserve the right to suspend, restrict or terminate access to the Website for any reason at any time.

6.3 These Terms and Conditions shall be deemed to include all other notices, policies, disclaimers and other terms contained in the Website, provided that in the event of a conflict between any other terms, these Terms and Conditions shall prevail. If any of these Terms and Conditions is held to be invalid or enforceable, the remaining provisions shall remain in full force and effect.

6.4 No waiver by us shall be construed as a waiver of any preceding or succeeding breach of any provision.

6.5 If any part of these Terms and Conditions shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed to be severable from the Terms and Conditions and shall not affect the validity and enforceability of any of the remaining provisions of the Terms and Conditions.

6.6 We shall ensure that we comply with the requirement of all current data protection legislation including, without limitation, the Data Protection Act 1998 (as replaced, modified or re-enacted from time to time). We shall only use personal data received from you for the purpose of fulfilling our obligations under these Terms and Conditions.

6.7 These Terms and Conditions shall be governed by and construed in accordance with English law and the parties agree to submit to the exclusive jurisdiction of the English courts.

7. Jewellery

7.1 If your impression kit or returned print gets lost in the post this is beyond our control. There will be a kit re-issue fee to pay before we can send you another kit. We do not routinely inform you when your print arrives in the post. If you have a deadline it is up to you to check with us that the print has arrived in time for it.

7.2. If you do not follow the instructions in the impression kit and we cannot use your print we will charge per kit to send you replacements.

7.3 Each jewellery piece is hand-made to your specification. We make a stamp from each print and use that to make the impression. This process is done by hand and as such there will be some variation in size and depth of prints. We allow for a 10% variation in our jewellery work.

7.4 The impression kit material is supplied to us under a special contract. We can allow you to use the impression material to make your print impression but the ownership of it remains with us. We make a stamp from each impression print and use it to make the jewellery. The stamp can be sold on to you or stored so we can make additional jewellery items/replacements in the future.

7.5 As your order is completely personalised you may return for a refund completed products only if the item is faulty or personalisation details do not match those provided by you. These products are hand made and each one is as individual as the prints they showcase. We can make anything to your requirements however, specific requirements must be made clear on return of your impression kit and consultation will be made with you in the unlikely event your requirements cannot be met. If no specific requirements are given then Always Keepsakes and Castings has complete liberty to place the print and/or wording in whatever format, wherever seems most appropriate to Always Keepsakes and Castings and you accept that when placing your order. Replacement products for faulty or incorrect items are provided under further consultation between you and us.

7.6. If you do not return your prints within 6 months and the price of your ordered item has increased, you will need to pay any difference in price in order for us to proceed with your order. This is because the price of silver can rise sharply.

9. Castings

9.1 All castings, jewellery or other keepsakes made by us must be collected within 6 months of completion unless an arrangement has been made. Any casts not collected within 1 year will be disposed of or used as samples.
